Terms of Service
Last updated: October 5, 2026
OVERVIEW
We operate this online store and its related content, features, products and customer services (the “Services”). Our store is hosted on Shopify.
These Terms of Service govern your use of our website and purchases from us, together with the applicable information provided before purchase and the following policies:
-
Return and Refund Policy
-
Shipping Policy
-
Privacy Policy
Please read these Terms before placing an order. You will have an opportunity to review your order and the applicable terms before completing your purchase.
Nothing in these Terms excludes, restricts or replaces mandatory consumer rights. If applicable law provides greater protection than these Terms, that protection applies.
SECTION 1 — ELIGIBILITY AND ACCOUNTS
To place an order, you must have the legal capacity to enter into a binding contract under the law applicable to you. If you do not, a parent or legal guardian with the necessary capacity must place the order on your behalf.
You must provide accurate and current information reasonably necessary to process your order, including your contact, delivery and payment details.
If you create an account, take reasonable precautions to protect your login credentials and notify us if you suspect unauthorised access.
You are responsible for activity you authorise. These Terms do not make you automatically responsible for unauthorised activity caused by our security failures or other circumstances for which applicable law does not hold you responsible.
SECTION 2 — OUR PRODUCTS
CastView offers consumer electronics, including headphones with an integrated camera and Bluetooth functionality. The specifications, included accessories, compatibility requirements and available features of each product are described on its product page.
We are responsible for supplying goods that conform to the contract, their description and applicable legal requirements.
Screen settings may cause minor differences in how colours appear. This does not excuse material differences between the product supplied and its description.
Claims about recording resolution, battery life, storage, sound, connectivity or water resistance apply only as expressly stated for the specific model purchased, including any disclosed testing conditions or limitations.
Do not assume that a product is waterproof, suitable for submersion or compatible with every device unless its specifications expressly confirm this.
We may update our catalogue or discontinue products for future sales. Changes will not alter the agreed characteristics of an existing order without your consent or another lawful basis.
SECTION 3 — ORDERS AND CONTRACT FORMATION
When you submit an order, you make an offer to purchase the selected products at the price and on the terms displayed at checkout.
A contract is formed when we send you an email expressly accepting your order. If an email only acknowledges receipt rather than acceptance, it will clearly state this. Dispatch of your order also constitutes acceptance if acceptance has not already occurred.
Before acceptance, we may decline an order for an objective reason, such as unavailable stock, unsuccessful payment, reasonable indications of fraud or a legal restriction affecting the sale. We will notify you and promptly refund any payment collected for an order we do not accept.
After acceptance, we will not cancel or materially change your order merely at our discretion. Any cancellation or change must have a lawful basis or your agreement.
Please contact us promptly if you wish to change or cancel an order. If dispatch can no longer be stopped, your applicable withdrawal, return and other consumer rights remain available.
We will not substitute a materially different product without your agreement.
SECTION 4 — PRICES, PAYMENT AND PROMOTIONS
The applicable product price and payment currency will be displayed before you place your order.
Prices will include taxes where required by applicable law. Delivery charges and any other charges we collect will be disclosed before you commit to the purchase.
For international orders, we will disclose whether import duties, import taxes or clearance charges are included or may be payable separately. Where a charge cannot reasonably be calculated in advance, we will explain its possible application and who is responsible, as required by law.
You will not be required under these Terms to pay undisclosed charges that applicable law requires us to disclose or bear.
Your bank or payment provider may apply its own currency conversion or international transaction fees under your agreement with that provider.
You must use a payment method you are authorised to use. Payment authorisation and collection will follow the information shown at checkout.
Price changes apply to future purchases and do not retrospectively increase the price of an accepted order.
Promotional conditions, including eligibility, duration, quantities and any bundle discount allocation, will be disclosed before purchase. Promotions do not remove statutory consumer rights.
SECTION 5 — SHIPPING, DELIVERY AND RISK
Available destinations, delivery charges, processing times and delivery estimates are described in our Shipping Policy and the information shown before purchase.
International delivery is available only to destinations we can lawfully and operationally serve. References to worldwide shipping do not mean that every country or territory is available.
We will fulfil orders within the agreed timeframe and comply with applicable shipment and delivery deadlines.
If a delay occurs, we will inform you and provide any cancellation, refund or consent options required by law. An estimated delivery date does not remove your legal remedies for late delivery or non-delivery.
For deliveries arranged by us, we bear the risk of loss or damage until you, or a person you designate other than the carrier, take physical possession of the goods.
If you independently appoint a carrier that we did not offer, different risk-transfer rules may apply where permitted by law.
Contact us if your parcel is missing or arrives damaged. We will investigate and provide the remedy required by law. You will not be required to resolve the matter solely with our carrier or supplier.
SECTION 6 — RETURNS, WITHDRAWAL AND REFUNDS
We offer a voluntary 30-day return period, subject to the conditions described in our Return and Refund Policy.
This voluntary policy is additional to statutory withdrawal rights, legal guarantees and remedies for defective, incorrect or non-conforming goods.
Where EU or UK distance-selling rules apply, consumers generally have a statutory 14-day withdrawal period, subject to applicable legal rules and exceptions. The procedure, return costs, refund arrangements and optional withdrawal form are explained in our Return and Refund Policy.
Neither dispatch nor expiry of our voluntary return period automatically removes any continuing statutory rights.
SECTION 7 — SAFE AND LAWFUL PRODUCT USE
Use the product in accordance with the supplied instructions, its stated specifications and reasonable safety precautions.
Do not operate or adjust the device in a way that distracts you from driving, navigation or another activity requiring your full attention. Follow the charging, battery and environmental limitations stated in the product instructions.
When recording audio or video, you are responsible for complying with applicable privacy, recording and consent requirements and respecting other people’s rights.
Where possible, back up recordings you wish to retain, particularly before a return, repair or reset.
These responsibilities do not exclude our liability for defective products, inadequate instructions, misleading descriptions or any other matter for which we are legally responsible.
SECTION 8 — INTELLECTUAL PROPERTY
Website content, including our branding, text, photographs, graphics and design, is owned by CastView or used under appropriate permission, except where another owner is identified.
You may browse the website, share links and save or print information reasonably necessary for personal shopping, record keeping or exercising your legal rights.
Other reproduction or commercial exploitation requires permission from the relevant rights holder, except where permitted by law.
These Terms do not restrict lawful quotation, criticism, review, accessibility uses or other statutory exceptions.
Shopify and other third-party names and marks remain the property of their respective owners.
SECTION 9 — OPTIONAL TOOLS AND THIRD-PARTY LINKS
Our website may include tools, integrations or links supplied by third parties. Separate terms may apply when you choose to use an independent third-party service.
We do not control unrelated third-party websites and do not guarantee their content simply because we link to them.
However, using a third-party payment provider, carrier, fulfilment supplier or other contractor does not remove our obligations to you as the seller.
Nothing in this section excludes responsibility for our own conduct or any liability that cannot lawfully be excluded.
SECTION 10 — RELATIONSHIP WITH SHOPIFY
Shopify provides the technology used to operate our store. Unless expressly stated otherwise before purchase, your contract for products sold by CastView is with the legal seller identified in these Terms, not with Shopify.
Questions about orders, delivery, returns, refunds and product complaints should be directed to CastView at casttview@outlook.com.
If you separately use a Shopify consumer service, that service may be governed by Shopify’s applicable terms.
Nothing in these Terms requires you to waive a claim against Shopify or another party where that claim cannot lawfully be waived.
SECTION 11 — PRIVACY AND PERSONAL INFORMATION
Our Privacy Policy explains how personal information is collected, used, shared and retained, together with the rights available to you: [INSERT LINK].
Shopify and other service providers may process information in connection with operating the store, taking payments, fulfilling orders and providing support. Relevant information about their roles and any international transfers is provided in our Privacy Policy.
Accepting these Terms does not, by itself, constitute consent to optional marketing, non-essential cookies or other processing that requires separate consent.
Where consent is required, it will be requested separately. Withdrawal of consent will not affect processing that remains lawful on another basis.
SECTION 12 — REVIEWS AND CUSTOMER CONTENT
You may submit reviews, feedback or other content where the Services allow it. Reviews must reflect genuine experience, and any relevant incentive or relationship should be disclosed.
You retain ownership of the content you submit.
For content you intentionally submit for public display, you grant us a non-exclusive, royalty-free licence to host, reproduce and display that content in connection with the relevant review or community feature. We may allow our service providers to process it for that purpose.
This licence does not give us unrestricted permission to use private messages, personal recordings or your identity in advertising. We will obtain additional permission where required.
We may make necessary formatting changes, but we will not alter a review’s meaning or present it misleadingly.
We may remove unlawful content, spam, personal information disclosed without permission, fraudulent reviews or content that infringes another person’s rights. We will not remove or penalise an honest review merely because it is negative.
Nothing in these Terms prevents you from making lawful complaints, sharing honest opinions or contacting a regulator.
SECTION 13 — ERRORS AND INACCURACIES
We may correct typographical errors, inaccurate information and outdated content.
If an error materially affects your order, we will contact you and explain the available options. We will not automatically charge a higher price or substitute different goods without your agreement.
For an accepted order, any cancellation based on a pricing or other error must be permitted by applicable law. If an order is lawfully cancelled, we will promptly refund the affected payment.
This section does not excuse misleading advertising or failure to provide goods as agreed.
SECTION 14 — PROHIBITED USES AND AUTOMATED ACCESS
You must not use the Services to commit fraud, impersonate another person, distribute malware, infringe intellectual property or privacy rights, harass others, gain unauthorised access or interfere with the store’s security or operation.
Automated tools and agents must respect applicable access restrictions, identify themselves where reasonably required and must not bypass authentication, security controls or anti-abuse measures.
You may not use automation to place unauthorised orders, collect personal information unlawfully or overload the Services.
These restrictions do not prohibit lawful accessibility tools, authorised shopping assistance, honest criticism or the exercise of consumer rights.
SECTION 15 — SUSPENSION AND TERMINATION
We may restrict access or suspend an account where reasonably necessary to address a material breach, fraud, security concerns or a legal requirement.
Where appropriate, we will explain the reason and provide an opportunity to resolve the issue. Immediate action may be necessary where advance notice would create a security risk or conflict with the law.
Account suspension or termination does not cancel your rights concerning existing orders, refunds, legal guarantees, complaints or personal information.
We remain responsible for obligations that arose before termination.
SECTION 16 — STATUTORY GUARANTEES AND WEBSITE AVAILABILITY
We will provide goods that meet the contractual and legal standards applicable to your purchase, including relevant requirements concerning description, quality, fitness for purpose and durability.
Any commercial warranty is additional to statutory protections and does not replace them.
We do not sell consumer goods under a blanket “as is” disclaimer that removes mandatory guarantees.
We aim to keep the website available and accurate, but maintenance, updates and technical incidents may occasionally interrupt access. Such interruptions do not remove rights relating to an order already placed.
Where a product includes digital elements, we will comply with applicable obligations concerning conformity and necessary updates.
SECTION 17 — LIABILITY
We are responsible for losses and damage for which applicable law makes us liable, including those arising from our breach of contract, negligence or defective products.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, mandatory product liability, or any other liability that cannot lawfully be excluded or limited.
We are not responsible for losses caused solely by your unlawful conduct or misuse contrary to adequate product instructions, to the extent permitted by law. This does not excuse a product defect or our own contribution to the loss.
Any assessment of causation, foreseeability, compensation or limitations will follow applicable law. These Terms do not impose a blanket exclusion of direct losses or a universal cap equal to the purchase price.
SECTION 18 — RESPONSIBILITY FOR BREACHES
If either party breaches these Terms, any resulting claim will be assessed under applicable law.
You are not required to indemnify CastView, Shopify or our service providers merely because you browse the website, purchase a product, submit an honest review or exercise a legal right.
Any claim we bring for damage caused by unlawful conduct or a breach must have a valid legal basis. Legal costs may be recovered only where permitted by law or awarded by the competent court or authority.
SECTION 19 — SEVERABILITY
If a provision is unlawful, unfair or unenforceable, it will not bind you to the extent provided by applicable law.
The remaining provisions will continue to apply where the contract can lawfully continue without the affected provision.
This section does not authorise us to rewrite an unfair provision in a way that reduces your consumer protection.
SECTION 20 — CONTRACT DOCUMENTS AND INTERPRETATION
Your contract includes these Terms, the order details, applicable policies and relevant information or promises provided before purchase that form part of the contract under applicable law.
Nothing here excludes binding product descriptions, legally relevant advertising, express commitments or representations on which the law allows you to rely.
If documents conflict, mandatory law takes priority. An expressly agreed order-specific term takes priority over a general term, subject to consumer protection requirements.
Any ambiguity will be interpreted under applicable law, including any rule requiring consumer terms to be interpreted in the consumer’s favour.
A delay in enforcing a right does not automatically mean that right has been waived.
SECTION 21 — TRANSFER OF RIGHTS AND OBLIGATIONS
We may transfer our rights or obligations to another organisation only where permitted by law and without reducing your contractual or statutory protection.
We will notify you where required and obtain your consent where necessary.
You may transfer your rights where applicable law permits. Nothing in this section prevents you from giving a purchased product as a gift or exercising rights that legally pass with it.
SECTION 22 — APPLICABLE LAW AND DISPUTE RESOLUTION
The law governing your purchase and the courts or authorities competent to hear a dispute will be determined by the applicable legal rules, including mandatory consumer and conflict-of-law provisions.
These Terms do not require consumers to bring claims exclusively in the country where CastView is established or waive protections available in their country of residence.
If you have a complaint, contact casttview@outlook.com with your order details and a description of the issue. We will investigate and respond within any deadline required by applicable law.
Contacting us does not prevent you from using a competent court, consumer authority, payment dispute process or available alternative dispute resolution mechanism.
Where we are required to provide information about a particular dispute resolution body or participate in a procedure, we will comply with that requirement.
These Terms do not impose mandatory arbitration or a waiver of collective remedies.
SECTION 23 — LANGUAGE AND HEADINGS
Headings are provided for convenience and do not limit the meaning of these Terms.
Where translated versions are provided, they must accurately reflect the applicable agreement. No language-precedence clause will override mandatory local-language or consumer protection requirements.
You may save or print these Terms for your records.
SECTION 24 — CHANGES TO THESE TERMS
We may update these Terms for future use of the Services and future purchases. The revised version will show its effective date.
Changes will not retrospectively alter an existing order or remove rights that have already arisen.
For an ongoing service, any material change will require a valid basis, appropriate notice and any consent or cancellation rights required by law.
Continued browsing alone will not be treated as consent to a change where express agreement is legally required.
